About the California withholding line (Form 593). California requires escrow to withhold 3 1/3% of the total sales price when the seller's property is not a principal residence (applies to residents and nonresidents). This is a prepayment of the seller's California income tax, not a cost of sale. It is credited on the seller's CA return and any excess is refunded after filing. It is not charged if the sale is a principal residence, the price is $100,000 or less, or the seller certifies another exemption (loss/zero gain, like-kind exchange, installment sale, CA corporation, etc.). A seller can elect to compute withholding on estimated gain instead (Form 593, Part VI). Confirm with your escrow officer and tax advisor. This is an estimate for planning only and is not tax advice. For investment property, this applies whether or not the owner lives in California.
Investment property. This report does not estimate income tax. For investment property, depreciation recapture, capital gains tax and a possible 1031 exchange can change what you keep after the sale. Please talk to a tax advisor before you sell.
